A Short Sale is a pre-foreclosure. Some of the short sales we handle in the Santa Clarita Valley, have not had a Notice of Default Filed. Some of the owners have not missed a payment – but the writing is on the wall.

As an attorney friend, Lou Esbin, of ours states, “the best time to inquire about a Short Sale is when the Sellers are current.” If you have missed a payment, you still need good advice and need to get into contact with a Short Sale Expert. Someone that has undergone the certification process with regard to Short Selling Homes and Properties. Short sales improve at a “snail’s pace”: "

More real estate agents are learning to transact short sales, and more homes are selling that way — for less than what’s owed on the mortgage, as long as the lender approves — instead of going into foreclosure.

But a real estate agent who regularly focuses on the big picture in Orange County says it’s not looking good. There’s improvement in moving short sales, he says, but it’s happening at “a snail’s pace.”

Steve Thomas of Altera Real Estate, who does a bi-weekly analysis of the Orange County housing market, writes:

“There is nothing more frustrating than short sales in today’s market. The name should be changed to ‘uncertain’ sales and there is nothing ’short’ about short sales.

“Some short sales are grossly under-priced and receive multiple offers above the list price. Yet, the final agreed upon price may still be too low, jeopardizing the lender’s approval of a short sale.

“In a short sale, there are three approvals that need to take place. First, the buyer must qualify to purchase the home. Second, the seller must have a true hardship, no money secretly tucked away, in order to qualify for a short sale. Last, the home must appraise for close to the agreed upon price between the buyer and the seller.

“A lender is not in a rush to accept a short sale payoff where the home is selling for $25,000 below the real market price. There are so many obstacles to putting a short sale together, it will make your head spin. Outstanding homeowner association dues, outstanding property tax payments, collection agencies, attorneys, first trust deed holders, second trust deed holders, all potentially stand in the way to closing a short sale.”

He says as of last week there were 4,311 short sales pending — 57% of all pending sales in Orange County. But only 627 short sales closed last month.

At that rate, he says, it will take some 7 months to deplete the pending short sales, and there are an additional 2,415 short sales listed.

All About Short Sales – that would be a great book, if I had the time to write it. Imagine, it would probably be a thriller with a bit of a conspiracy twist. Source Data? – Yup, that is good information from the beginning without any “selfishness” by the one giving the advice.

I received a call today from a man that has more than 1 short sale for The Paris911 Team to negotiate. Paris and I will be meeting with him tomorrow and give him the down and dirty regarding the Short Sale process. He will have his homework so we can hopefully negotiate his short sales and keep him safe.

There were 22 new listings total placed onto the market in the Santa Clarita Valley – 18 of which were Short Sales. Which makes up a huge amount of the inventory.

They can be very difficult to negotiate – That is why you need Certified Distressed Property Experts to do it for you.

Short Sales are also known as Pre-Foreclosures. Sad But True – in fact, sometimes the Short Sale negotiation does not work out for those that are thinking about Short Selling.

There are also some reasons that you will not want to choose the Short Sale Route – but to find agents that will be upfront and honest with you is sometimes a tough task.

Relocation does not stop at getting a Job Transfer. Switching Schools or other reasons, some might have to do with Divorce. If you are getting a Divorce and your assets are being ordered sold by the court - you are in a really bad place if you have negative equity with your real estate.

Relocating and moving away could be one possible option. But if you are being forced into a short sale - that is a completely different story.

You are going to need an expert in the negotiation of Short sales - also you are going to need agents that understand the happenings with regard to exparte communication. Every call, with a divorce case, is conferenced, every email is CC'd, every correspondance needs to be addressed to both parties.

Attorney Observed Short Sales

There is not a problem with the utilization of an attorney or legal team with the Short Sales in which we represent our Clients.

Some others in the Real Estate industry, think of Realtors (I should say themselves) as middle men.

I don’t see it that way at all. I know that our ability to advertise goes above any Real estate attorney that I have met to date. Furthermore, they are Real Estate attorneys – not interested in the Day to Day activities of Selling Real Estate – and Representing Buyers with their demands.

Plus – I am not sure I would feel comfortable having an attorney drive me around to help me find a home.

So – those worries are excuses because we were the premier Team in Santa Clarita Valley that is working with this Paris911 Exclusive Resource with our Clients Short Sales.

Running scared from the Short Sale

It would appear the hammer dropped And a bit of ugly was discharged. Facebook was in a small way heated with an exchange from a blog I posted about us hiring a legal team to assist our short sale sellers.

Points were of concern that my actions were going to render agents obsolete from the short sale process. Also that if I need to have an attorneys office involved in the short sale process than I could (hinting that I am less of capable).

Point 1: the attorney is a fail safe mechanism for our sellers. Any "legal" questions will be fielded on our dime. Also certain issues regarding the far future implications would be able to be addressed.

Point 2: I want what is best for our clients regardless if I am making less $$$. It is the right thing to do. And yes. It not only protects my team but the seller as well.

Paris became involved in the discussion and like an experienced mma grappler finished the hostile parties with her usual precision.

A legal team on retainer is not absolutely necessary with regard to short sale completion and negotiation. Realtors do a fantastic job with the CDPE certifications. It is merely something that we dispatch for our clients. If you have an agent representing you, stay loyal. This is for our clients and followers only.
